Terms and Conditions of Services and Related Products

Rocket City Photo strives to provide fair, accurate, and professional services and products. Due to the artistic and visual nature of photography, videography, measurements, and digital media services, certain details may be omitted, altered, or subjectively represented. These services and products are intended solely for marketing purposes and may not depict or convey all information that could be important or material to a reasonable person when making decisions related to the purchase, sale, lease, or use of real property.

Examples of such limitations include, but are not limited to, paint color appearance, perceived room size or orientation, property condition, lighting conditions, nearby features, and environmental factors.

For purposes of these Terms & Conditions, “Client” is defined as any individual, company, or entity that requests, schedules, uses, or orders any services or products provided by Rocket City Photo. The Client is responsible for all communication, coordination, access, permissions, and financial obligations associated with the services or products ordered.

By scheduling or using any Rocket City Photo services or products, the Client agrees to these Terms & Conditions.

Scheduling Delays & Cancellations

A minimum of twenty-four (24) hours’ notice is required for all scheduling delays, cancellations, reschedules, or no-shows.Failure to provide adequate notice may result in a $50 cancellation fee per scheduled service, if Rocket City Photo is unable to successfully fill the reserved time slot for Single-Family Residential Properties. Failure to provide adequate notice may result in a $100 cancellation fee per scheduled service, due to extended on-site time and resource allocation for all other properties (including but not limited to commercial properties, multi-family properties, apartment complexes, builders, construction projects, and non–single-family homes). Failure to gain access to the property necessary to complete scheduled services is considered a no-show and subject to the same fees.Rocket City Photo understands that scheduling may involve multiple coordinating parties and may, at its sole discretion, waive a cancellation fee for repeat clients in good standing, provided advance notice was given and no prior scheduling issues exist. Rocket City Photo reserves the right to cancel or refuse any service or order at any time, for any reason.

Property Access

To perform services, Rocket City Photo may require access to the property. The Client grants permission for Rocket City Photo to access the property using information provided by the Client, including but not limited to lockbox codes, door or garage codes, hidden key locations, or electronic lockboxes. The Client is solely responsible for obtaining any required permissions from property owners, tenants, HOAs, or other parties. The Client assumes full liability for any claims, penalties, fines, or disputes arising from property access, including misuse or alleged misuse of electronic or physical access methods.

Property Condition

The Client is responsible for ensuring the property is photo ready at the scheduled appointment time. Rocket City Photo’s services do not include cleaning, staging, decluttering, repairs, or property preparation unless expressly stated in writing. Rocket City Photo reserves sole discretion to determine whether a property is reasonably photo ready. The Satisfaction Guarantee does not apply to dissatisfaction arising from property condition, cleanliness, clutter, damage, construction, or preparation issues that are outside Rocket City Photo’s scope of work.

Special Requests

All photo counts, angles, styles, and special requests must be communicated at the time of scheduling or ordering. Requests made after the appointment or after delivery are not guaranteed and may require additional fees, rescheduling, or a return visit. Such requests may be declined at Rocket City Photo’s discretion.

Square Footage, Pricing Tiers & Misrepresentation

For pricing purposes, unfinished areas (including but not limited to garages, basements, pool houses, and similar structures) are counted toward total square footage unless otherwise stated. If the size of the property is misrepresented at the time of scheduling or ordering, Rocket City Photo reserves the right to adjust the invoice to reflect the actual property size, and/or issue an additional invoice if partial payment has already been received. Delivery of services or media may be withheld until outstanding balances are resolved.

Certified Measurements & Floor Plans

Rocket City Photo employees and contractors performing measurements are certified in accordance with applicable MLS and association standards and follow ANSI Z765 guidelines. Measurements and floor plans are not appraisals or surveys and are, by definition, not exact measurements. While reasonable efforts are made to ensure accuracy, Rocket City Photo cannot guarantee measurements due to factors including equipment limitations, physical access restrictions, and human error.

Watercolor Home Portraits

Due to the custom nature of this product, refunds and/or returns are not accepted for this item. Rocket City Photo will reserve time and resources for the creation of this item upon successful payment and begin utilizing the reserved time and resources upon as soon as the required information has been obtained. Rocket City Photo will make reasonable efforts to contact purchaser to obtain any missing information by phone number and/or email address submitted during ordering for completion of the order, but may cancel the order with partial refund if required information is not received within seven (7) days.

Virtual Staging

Rocket City Photo provides a digital virtual staging service to incorporate virtual staging elements such as furniture, decorations, and other interior design components. The nature of virtual staging services is inherently artistic and subjective. As with all our services, there may be elements that are important, significant, or essential to a reasonable person in deciding whether to engage or not to engage in the purchase or sale of real estate that are not depicted or are depicted differently in the virtually staged images. Examples include, but are not limited to, the actual dimensions, colors, and textures of the property and items within it. The Client is responsible for all communication, coordination, and financial obligations associated with the use of these services or products. The Client also acknowledges that Rocket City Photo’s virtual staging services are intended solely for marketing purposes and should not be considered an accurate representation of the property’s current or future condition. In addition, the Client agrees to hold Rocket City Photo harmless and indemnify it from any claims arising from the use, publication, or distribution of virtually staged images. Rocket City Photo reserves the right to refuse virtual staging services if the result may be misleading or violate laws, regulations, or ethical standards.

Satisfaction Guarantee

Due to the artistic and subjective nature of Rocket City Photo’s services, a limited satisfaction guarantee is available for the following single family residential real estate services: Standard Listing Photography, Drone/Aerial Photography, Videography, and Virtual Twilight service with specific considerations. Eligibility for the satisfaction guarantee requires clients not publish/use media or to discontinue all use of said media and contact Rocket City Photo within 48 hours of media delivery. Eligibility for the satisfaction guarantee also requires property must not have changed status (sold, leased, rented, or under contract) within 72 hours of media delivery. Client’s remedy for the satisfaction guarantee allows for a single choice between a refund of the single service, not including any travel fees, or a single reshoot attempt, provided the property condition is substantially similar to the original service date. The satisfaction guarantee is limited to a single instance per client, does not apply if the property was not photo ready or access was unavailable, does not apply to additional requests beyond the original order, and does not apply to Matterport, Zillow 3D Tours, Virtual Staging, Virtual Marketing services, or Airbnb Photography once the service has been performed.

Promotional Credits & Giveaways

Rocket City Photo may offer promotional credits or giveaways. These promotional credits and giveaway rewards, are non-transferable, are one-time use only, cannot be combined with other offers or promotions and expire one (1) year from issuance unless otherwise stated. Promotional credits do not include travel fees, add-ons, or extras unless explicitly stated in writing.

Unpaid Balances

Invoices are due within 30 days unless otherwise stated. Unpaid balances may incur a $100 late fee for each additional 30-day period. Rocket City Photo reserves the right to pursue collection, file suit, and/or file a contractor’s lien in accordance with Alabama Code § 35-11-210. Invoice splitting is available upon request and subject to a $50 fee per split.

Limit of Liability

In no event shall Rocket City Photo be individually liable to a 3rd party (non-client) for any damages unless our act or failure to act involves intentional misconduct, fraud, or a knowing violation of the law. Client agrees to limit Rocket City Photo’s liability arising from services and products, errors or omissions, such that the total liability of the Rocket City Photo shall not exceed the client’s total fees for products and services rendered by us for the listing address.

Governing Law & Venue

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Alabama, with venue exclusively in Morgan County, Alabama.
